The thesis develops an analysis of the designs of public policies that address disability in Chile, based on the evaluation criteria of the CA of Amartya Sen (functionings-capabilities-agency-wellbeing-freedom-achievement). The approach is theoretical, exploratory and qualitative-interpretative, through a content analysis of the texts of 9 legal norms.
Policies are understood as proactive government actions to achieve an objective, and as a social construction that expresses a plurivocal meaning that can be interpreted. The analysis of intentioned functionings allows knowing the public interest regarding disability.
A methodology of analysis is formulated, based on the systematic use of conceptually ordered matrices, proposing a structure and an argumentative pattern, and a system of evaluation of the propositions of intentions.
The main elements and characteristics of the CA are taken into account, and the possibility of using this approach for the analysis of public policies and of disability is demonstrated.
For each functioning, it was possible to find an equivalent expression in the CRPD, that is, they are within the functionings valued by people with disabilities. However, the treatment of each category and evaluative point of the CA is diverse, divergences and contradictions even within the same norm and even in the treatment of the same functioning are found, to the point of discarding in an article that what is said in another.
It was found that the wellbeing aspect is the most favored; Freedom, on the other hand, is the most damaged; the Achievement receives a selective treatment, and the Agency is the most ignored. Policies on disability have focused on developing the aspect of Wellbeing; however, in this effort, they have forgotten to develop other aspects, and even damaging the same Wellbeing that they are supposed to promote.
Analysis in the final design stage allows visualizing the intentions of creation and enhancement of functionings and capabilities in public policy; but policies whose contents are not coherent add an element of instability to the following stages of the public policy cycle and will hardly achieve the objectives sought, since, in fact, they are not recognizable. This could be avoided by analyzing the design of public policies during their elaboration process; nevertheless, it is not without value to carry it out in already promulgated norms, in order to modify and improve them.
